Asylum Laws in Texas
Houston Immigration Attorney
The United States is considered a place of safety for refugees seeking protection from persecution in their country of origin. Article 14 of the Universal Declaration of Human Rights discusses the right of all people to seek refuge from persecution in other countries. The United States offers safety for individuals coming from other countries where they have suffered persecution or are in reasonable fear of persecution based on protected characteristics.
Protected characteristics include:
- Race
- Religion
- Membership in a particular group
- Political beliefs
If you are eligible for asylum from United States Citizenship and Immigration Services (USCIS), then you can find refuge in the country. Asylum is obtained by applying and filing Form I-589, which is the Application for Asylum and for Withholding of Removal. This form will need to be filed within one year of arriving in the United States. When you apply, you can include your spouse and unmarried children under the age of 21 who are also in the U.S.
Applying for Asylum
Obtaining asylum requires you to fulfill various requirements and ensure that your application is accurately completed. You must be able to establish past persecution, in which case the burden of proof is on the government to demonstrate that those circumstances are no longer present. If the applicant has lawful immigration status, he or she can submit an application for asylum to USCIS. If the application is denied, the case will be referred to an immigration judge.
Withholding of Removal
In order to qualify for withholding of removal, the person will need to demonstrate that it is more than likely that he or she will suffer persecution if forced to return to his or her country or origin. Obtaining withholding of removal is much more difficult because of higher standards of eligibility. It is also different in that it does not necessarily lead to permanent residency in the country. After several years of "hiding" in the United States in fear of being caught and deported, I found Ms. Rodriguez, and she helped me find a way that I could stay in the United States and get my green card! She walked me through every step of the process, in my native language (spanish) and was very clear. She always took extra time to explain things in a way that I can understand, and she went with me to my interview, and was there for emotional and legal support during the entire process. I was quite happy with the process, she is reasonably priced, and even though the interview was terrible and the adjudicator accused me of many horrible things, Ms. Rodriguez defended me and I got my green card approval within the week! I got my green card within 2 weeks after that!- Brenda

After being in the United States for over 5 years with no legal status, I had the fortune of meeting Ms. Rodriguez and she helped me to obtain legal permanent residence in only 7 months! I don't know if this is normal, but she was very kind to me throughout the process. Also, she never got tired of explaining things to me over and over again, and she has a way of calming her clients so that they don't stress too much about their immigration case. Overall, I must say that Ms. Rodriguez is very intelligent, very dedicated, and will do whatever she can to help all of her clients. She has a great heart, which is not very common for a lawyer, and she truly understands the adversity and the fear of many immigrants like me of having to go back to their home country. I would recommend Ms. Rodriguez without hesitation.- Jose

Rebekah did a wonderful job! We were very close in the process to be approved for our green card but then the news came, we were denied because not delivering the correct RFE. She was immediately sure there was a mistake made and started her investigation. In 3 weeks, she turned our case from denial to having our green cards in the mail. couldn't be happier! Thanks Rebekah!
